I mean... with the separation of powers issue, I would think Roberts would still say they can impeach him for whatever they want. I'm just confused as to why he thinks the judicial separation of powers means courts can't even look at this stuff.

Now couple this with the pardon power... you can add the pardon to the soldier and even sign a preemptive pardon that can't be questioned because it's a core power!!!!

Ordering the military is a core power... even if it wasn't... it's an official act... even if it wasn't it's presumed immunity and you can't actually bring any of the illegal orders into evidence. Even though he broke the law, he's immune because there's no evidence

So... I can order a soldier to shoot a senator. If he refuses, I can tell him that I'll replace him and add him to the list. Eventually, he either finds someone that will shoot everyone, or the scheme fails. Either way.... no prosecution.

This SCOTUS ruling was giving the president immunity from the courts, and presumed immunity for any claimed actions, and even immunity from evidence Courts can't stop them if they're immune from courts. It's like D&D and acid resistance

I don’t think it’s an exaggeration at all to say the decision threatens the Republic. I might not have said so in 2015, before I saw how triumphantly lawless and autocratic the President could be, and how so many people would applaud it or at least shrug.

Presidents don't actually DO the work, themselves. They tell other people to do the work. The work getting done is an extension of their will, however, as the court sees it. While they left the opening there... This court will never allow Bill Barr to be prosecuted for carrying out orders

I mean... the ruling very explicitly did not rule on the transfer of the orders... If I tell my Treasury Sec to eliminate all student loan debt in defiance of Supreme Court orders, it's not clear at all that my immunity wouldn't transfer. The court implies it does.

Bad use of conservative Judicial conservatism is based on the idea of minimalism. This opinion is ANYTHING but minimalist. This is a radical opinion. It's time to leave conservative off the adjective-list, as now it's ambiguous. This is a radical ruling in favor of politic conservatives

It also dulls idiosyncrasies. Gorsuch is uncommonly liberal with Native American treaties. Roberts used to be judicially conservative. When it's 6-3, the idiosyncrasies disappear and only appear as 5-4 dissents instead of 5-4 victories for the status quo. Now, Gorsuch has to bring a friend

You've echoed most all of my thoughts. My worry is Biden's handlers were so caught off guard. That tells me that they haven't been interacting with him much at 9-10pm. My worry is that this was a time of day issue. If he's sundowning and that's why his team was caught off guard. Can hedo itnow?
