Exactly. But likewise the copyright holder -not the fanfic writer- is most likely the one who has to put in the take down notice I'm currently asking an IP lawyer I know about that situation, simply because I'm interested

As said, but I want to make it even more clear: the fanfic author has copyright for the fanfic. The original works' author has copyright for the original works. The "for sale or not" mostly matters in that there's no money in suing free fanfic, so no one actually does (& it might not win!).

No, the copyright holder is the fanfic writer. This is why most authors are contractually obligated not to read fanfic. If the fan writer can prove they read it, and then the original IP holder uses it, the original IP holder has violated the fanwriter's copyright, yes I'm serious.
