My take on Thomas is that he’s so full of hate, for everyone including himself, that he just wants to burn the country to the ground. If you want to know how Thomas will vote in every case, just figure out what result would have the most destructive effect on the country.

I agree that the majority opinion is solid. I wouldn’t count on a majority of this court ever holding that realization is not a constitutional requirement for income.

Concocting the term “constructive realization” was either gross incompetence or breathtaking dishonesty by the taxpayers’ counsel, but Barrett’s and Alito’s concurring opinion, which relied on misuse of the “substance over form” doctrine to hold for the government, wasn’t much better.

This was really a 5-4 decision, much closer than it should have been, since Barrett’s and Alito’s concurring opinion is nearly as stupid as Thomas’s dissent, and relies on a misuse of the “substance over form” doctrine to hold for the government.

The first two episodes were average, the third episode (Boom) was well above average and the fourth episode (73 Yards) was really excellent and memorable. Anyone who cares about the Doctor who isn’t watching this season is missing out.

Tax lawyer here. If you can’t resolve this today you should file return by certified mail. They won’t be able to charge a late filing penalty, or interest if you owe tax. Alternatively you could file for an extension, but either way if you owe tax you should mail it today.

It’s a small point but the Times refers to a case challenging regulation of herring fishing, apparently not realizing (or choosing not to mention) that that case is another right-wing put-up job whose purpose is to overrule Chevron, with the goal of destroying the U.S. regulatory state.

Yes, frivolous voter challenges are a common thing to look out for. If the line gets too long I would talk to voters coming out and ask them what’s causing the delay. If there’s anything shady going on the boiler room would either call the Board of Elections or get a court order.
