A more careful President would just issue a blanket pardon while still in office, but I wouldn't bet against this Supreme Court inventing yet another immunity to say that wasn't even necessary.

It will be a Walt Nauta type. Someone who participates in a criminal conspiracy and is prosecuted as a minor player. They'd be someone the President forgets to pardon, and who doesn't have the awareness or clout to ask. Their lawyer later uses this decision to avoid having to plea and cooperate.
