At the risk of being tiresome in reposting my own writings on the separation of powers and executive accountability, since prominent scholars are now in the news saying "habeas corpus will still be OK"— Montesquieu's insight was precisely that it won't be.
Lawyers told Trump he could have people arrested and executed, and he apparently believed them. Compare to Lin Wood, who was in on some of that work, calling for the arrest and execution of Pence, McConnell, and Roberts. He tweeted that publicly. It seems to be Trump’s theory now.
Yeah he’s calling for military tribunals of people like Liz Cheney. He’ll move on to rendition to Bkavk sites soon. Don’t forget the firing squads executive order in December, 2020 came out the same day as the infamous meeting in the Oval Office where martial law and other ideas were proposed.
Well, at least there is no precedent of presidents suspending habeas corpus. Or just ignoring it to imprison more than a hundred thousand people based on a racist assumption the Supreme Court happened to share.
These law school dudes saying such soup-brained things like “the guy with immunity for all official acts will obey a court order” need more political philosophy in their lives.
As I understand it Roberts argues that if presidents are subject to the law for their actions as president then political opponents might use that to arrest and try them and so this violates the separation of powers so presidents must be shielded for all time.

SCOTUS is doing the work of its handlers, the Federalist Society, to end America as we know it. This is not “originalism,” this is making up stupid s**t to justify a ruling. The SCOTUS Six are the Joe Rogan of judges.
