I was hoping to learn something from the article about the effect of Loper on patent practice. Instead, the author seems to be prematurely celebrating the death of stare decisis in the absurd hope that the Court will reverse its unanimous holdings in Bilski and Alice.

US Patent 12,000,000 issued today for "Labeled Nucleotide Analogs, Reaction Mixtures, and Methods and Systems for Sequencing." The Patent Office didn't manifestly fiddle with the numbers like they did last time. (Patent 11,000,000 would otherwise have been a humble "soybean cultivar").

US Patent Number 12,000,000 will be issuing this coming Tuesday. Per usual practice, the Patent Office will probably hand-pick the invention assigned to that patent number to ensure it isn't something odd or unsettling.
