I'm 50/50. I think this stuff lacks political salience until it suddenly does a lot of the time, and what makes it salient often looks completely nuts to you and me.

In that case I think you would see the power abused inevitably. Whether it was retracted after the war? Well, now that's the question. My guess is that it might be folded into the presidential war powers... but that's still a huge bomb waiting to go off.

The hope is clearly that SCOTUS will have ultimate oversight, by only choosing to grant that immunity selectively to a Republican president.
This... does not seem like a smart gamble on their part. We could easily end up in a shooting civil war under a Democratic president with a 5-4 liberal court.
