Presidents have always been above the law in practice, but it was a self-regulating system among the ruling class. Trump got greedy and they were forced to write it down in black and white.

Modern presidential systems have typically ended up with at least one president locked up. The problem with the American presidential system is that it isn't really a presidential system, it's a latent 18th-century monarchy where nobody was quite willing to do full dress-up.

The self-regulating part becomes obvious when you realize it’s now within the bounds of the law for Biden to just get rid of Trump right now. Biden says he will still respect the law even after today’s decision but it’s literally legal for him to do whatever he wants.

The notion that a hypothetical assassination of a political rival was brought up in a lower court was weird enough. That it was affirmed by scotus isn't weird. It's fucking frightening.

Presidential pardons of people who were in presidential administrations have never been a sign of equal application of the law. Conservative justices agree with Trump that some people should be placed above the law, that applies to the rest of us. www.npr.org/2018/04/13/6...
