i think akhil amar reed captures something very important, which is that the roberts court rewrote article ii, which explicitly states that a president can be held criminally liable after impeachment (and which has long been understood to mean that he can be held liable after leaving office)

It's complicated this late in year. Each state has its own requirements to get on the ballot and right wing orgs are planning legal challenges should Biden step aside. Most likely the candidate would be Kamala Harris, all the other likely Dems are supporting Biden www.foxnews.com/politics/her...

The issue to be determined by a court will be was his conduct part of his "cord presidential powers". If a court determines yes, then the president has immunity for such acts. With how politically divided many courts are these days, it can be just a rubber stamp.

The distinction is whether it's unlawful or illegal. There's plenty of practices engaged in by rich people which are fraudulent but not unlawful or illegal. But law is not morality or ethics.
