Worse than unenforceable--they stood it on its head, changing the conditions from "an insurrectionist can stand for office only with approval from Congress" to "an insurrectionist can only be *barred* from office by act of Congress". Literal up-is-down-ism.
The only way I can see this bull working is for an actual executive order which may look like overstepping but is actually using common sense to resolve a made up ridiculous scenario.
It’s a matter of finding the best way to give Trump a path to President for Life without extending the same blanket rules to Biden or any Democratic challenger. They need to thread a very fine needle so any statements of immunity only apply to Trump.
I think the only reason Alito, et al. would delay the decision is because they have no other gift to deliver to their shriveled, orange lord and master but delay. He has lost and so they are dragging it out as long as possible to hopefully push the case past the election. At least, that is my hope
