I really thought I was cynical enough about the utter corruption of the right-wing bloc on SCOTUS, but it turns out I was still giving them too much respect.

The facts are *only* in dispute.

1. No official records exist about whether profs are liberal or conservative. That's a good thing--in a free society, we don't require such records. Any surveys are small, strictly voluntary, often poor in quality. 1/3 šŸ§µ

A president supporting court packing for the explicit purpose of reigning in presidential power, including his own, after a Supreme Court made a wildly un-American, precedent-breaking decision to expand it, would be making the best case for a president to support court-packing.

But could he be recalled, censured or simply not elected again in light of his overreach? Iā€™m interested here in cases where there simply is no recourse ā€” because that is what I take to be the main characteristic of informal political representation.

This is a very experimental post for me: I'm trying to think through a discursive operation, to historicize it and to explore its ethics with a colleague. But I need to conceptualize it first. Hence these NOTES ON BAD-FAITH CREDENTIALING open.substack.com/pub/adrianda...

Big hat tip to @jbouie.bsky.social for treating uncertainties as uncertain, with both downside and upside potential, rather than what many pundits are doing: imagine a positive scenario and act as if things will smoothly go that way if only people try it.

Doesn't seem like a high bar. And yet...

I think the way itā€™s supposed to work is: antisemitism among ā€œwokeā€ leftists weakened ā€œthe leftā€ (meaning apparently everyone from a dude in a keffiyeh at the Rostlaube all the way to Olaf Scholz), leaving the (to her legitimate) fear of Islamists to the right as election issue? Maybe?

Most of the other parties will do some light xenophobia, and keep kicking left. The AfD meanwhile will retain both its apparent Teflon status with average voters and the covert (and not-so-covert) advance accommodation from the elites, at least where its topics and language are concerned. (2/2)

Looking at the European Election results in Saxony, itā€™s hard to imagine a world where this doesnā€™t just keep getting worse and worse. The CDU will keep trying to push right and play on racism and culture war ā€” which will only help the AfD. (1/2)
