It always gives me whiplash to see a prosecutor, a group that is categorically incredibly creative at turning anything into a felony, suddenly unable to frame an armed assault as more than a misdemeanor.

Are we surprised? A lot of "prosecutorial descretion" was used as a BS excuse by tons of DAs across the country during 2020 to not bother charging or pursuing charges against right wing counter protestors who attacked BLM marches. See: Larry Arnold Davis, aka The St. Petersburg Gunman in Florida
