I vaguely remember reading about one lawsuit from many years ago of the form, "I was denied tenure but this less qualified woman was granted tenure," and discovery unsurprisingly documented that the male candidate was rejected for being an insufferable douchebag that no one liked.

My counter is that the alternative doesn't actually protect anyone else's rights, except by temporary demographic accident. Could get rid of undemocratic bullshit, *and* enshrine new rights. Of course they don't want new rights. They just want to deprive everyone else.

Founders explicitly rejected having a judicial body oversee all legislation, like 18th century NY. Judicial review only happened when relevant to an otherwise legitimate issue...

This logic is phenomenal. You can't trust the Chinese because they'll lie to protect their kin. That's why you need a witness of another race. And for some reason that race has to be white. Also this problem never comes up if a white person is being questioned, since they won't lie for each other.

My experience with my own healthcare provider is that any time a nurse or physician accesses my file for the first time, they have something to fill out establishing their need. Does obtaining genuine authorization by lying on such a form violate CFAA? No idea. Wonder if there's case law on that.

Isn't this the exact question that van Buren (2021) answered? If your credentials give you access to a file, it's not a CFAA violation, even if you're not supposed to. But did Haim simply have that access, or did he need to fill out (and lie on) forms to access info for specific patients?

I think they tried to draft rules so broad they covered every kind of electronic service, expecting courts or member state legislators to stop the application of those rules somewhere sensible. Official examples of regulation in action concern things like financial transactions and job applications.

Of course the ultimate effect of this is to make it as difficult and expensive as possible to exercise editorial control over private property, with courts substituting the property owners' opinions of content with their own, and selectively protecting some viewpoints more than others.
