The only appellate lawyer who doesn’t have a podcast. My practice is in Texas state and federal courts. I used to have a real blog.

Folks overfocus on the "what if drone strike opponent" question, but it seems to me the more relevant one is "what if President asks CIA to bug opponent's headquarters". Which normal people would correctly identify as a criminal action, and which, as I read this ruling, would be an official act.

Yes. It takes a president elected nationally and Senators from 25 other states to place any single federal judge in Texas.

Unless I’m missing something, their textual argument is so broad that it would also call into question the Legislature’s power to create Houston’s 14th COA. From the petition you cite:

It’s also striking that Gillers is relying on his own (perhaps willful) ignorance of the facts to opine about what a reasonable observer “who has all the facts” would conclude. Obviously, that can’t be right. Covering up an ethics breach does not remove its stench.

You reach a point where a friend dies and you say: sixty-one! that so young. When you are in your twenties and struggling that point is hard to visualize - you feel like forty more years will be too much. May all who struggle today live in the hope of knowing that sixty-one is so young, so young.

another great thing books do is they usually have a brief bio of the person who wrote the things in there, so you can get a sense if they are full of shit or not. more data sources should let you know if they were created by a total cretin.

I’ve been lurking in car forums for the last few months and saw reports from drivers of General Motors cars that GM was selling their driving data to LexisNexis. It was resulting in their insurance going up. Can that be true, I thought.

Reported it out. Yes. True.

Had they taken this extreme legal position earlier in the process? (The state’s argument that “appearance of impropriety” is irrelevant without also proving some apparently high degree of actual bias?)

First day of orientation I’m hanging around Batts Hall (no relation to actual bats!) and see this large-ish shiny black bird squawking and attacking another bird for its meal. I go “wtf is that thing?” and a classmate responds, “oh, that’s a grackle.” I swear I nearly fell over! GRACKLES WERE REAL?!

A fun thing you may not have focused on is that the rules don't require exactly 14-point, but just "no smaller than 14-point." So when you're trying to fine-tune, you can start with a font that renders too small (like TNR) and then define your styles to 14.5-point body text and 12.5-point footnotes.

I don't know what led you to Century, but other members of that family (esp. Century Supra) look better in legal writing. I've sometimes used Century Supra at 14 point, and it works. When things don't look right, the other two knobs to turn are line spacing ("exact") and margins (go wider than 1").

With respect (and fond memories of bankruptcy class), I think it works the opposite of how you are imagining. A debt being non-dischargeable does not give that creditor priority to be paid before other creditors. The stay ensures that all creditors with equal priority will get proportionate payment.
