Was she a cop? I don't think cops and DAs are the same at all. For a lot of DAs it's just another lawyer gig they do for a while. Lots of my former students started out at the DAs office to get experience and then switched to defense work.

Ohio v EPA is the first time SCOTUS has talked about the "knee of the curve" in an opinion. Mentioned repeatedly in Gorsuch's majority, and is singled out for criticism in Barrett's dissent. I need to explain this idea to students.

I'm interested in hearing your thoughts about it from the fisheries angle. I teach a few marine conservation cases. I've wondered what it is about the herring supply chain upline that supposedly prevents the trawler owners from passing the costs of onboard inspectors through to the customer base.

Admin law profs, do any of you teach Bureau of Alcohol, Tobacco and Firearms v. FLRA, 464 U. S. 89 (1983), in your course? It's cited in Loper Bright. Maybe that's the baseline for MQD now?

We have a 2018 law in TX that if I rent a room of MY OWN HOUSE to a grad student, I can't have a no-guns-in-my-house-rule. If a private retailer wants no guns in their store, they have to take up streetfront window space with required signage. It goes on and on.

The Third Reich had a LONG list of chancelleries, cabinet ministries, and "Office of ___." Fascists love bureaucracy just as much as Stalinists. Authoritarianism micromanages every aspect of society. This terms' decisions are just about clearing the slate of everything since the New Deal.

There are LOTS of things they want to regulate! In Texas, we have laws barring private corporations from all govt contracts if the company boycotts Israel, or divests from the fossil fuel industry or weapons manufacturers. Private companies are not allowed to require employees to get vaccinated.
