My assumption is it will just push up the fat and salt b/c that's the obvious flavor components that will come back from "analyzing" sources. But paying the energy costs for that seems insane to me. If it does something else, I'd be surprised but interested.

I think our disagreement comes down to our opinions of the justices. I don't think it's possible to cite Fed 69 in good faith and come to the conclusion Roberts did. I can't believe that Roberts read, "and would afterwards be liable to prosecution" and came to the conclusion he came to honestly.

The examples they use come from briefs they have. I'm sure they don't read every brief, but the examples are discussed in circulating drafts. A dissenter doesn't hold back historical examples just for their opinion without making the argument to the other justices.

Also, the reason they rely on briefs is b/c they're not trained in historical research b/c that's not a part of legal curriculum, which indicates something about Originalism. That's not even getting into the absence of any historical sources of the Founders saying we should abandon common law.

They know. Dissents generally point out conflicting historical authorities showing there wasn't a consistent historical practice. Those inconsistencies are generally ignored. Both pro and con examples almost always come from briefs, so they know well in advance of the opinion that is not clear

That discussion with Stephens, Goldberg, Healy and Bouie in the NYT was embarrassing. Only Bouie seemed to have any grounding in reality and was really the only one who tried to form an argument based on more than personal vibes.

There was a 30% decline in viewership from last campaign season's debates. I'm assume b/c most of us already know how we're voting and don't feel like listening to that crap. I don't know if the press is banking on that and trying to shift opinion through headlines, but it kind of feels that way.

This is great. Yesterday SCOTUS issued an opinion where they screwed up b/c they didn't know the difference between nitrous oxide and nitrogen oxide. Today they are saying only they are smart enough to make decisions about complicated things like nitrogen oxide. It's fucking wonderful. /s/

Lincoln directly criticized Stephen's '54 Kansas Nebraska act as a failure of congress to uphold the Constitution. You don't compromise the Constitution b/c it's politically expedient. His Peoria speech on the passage of the KNA goes through a history of the broken compromises.

In Oregon it looks like we're seeing some of it. It's a weird circumstance b/c the effect is concentrated in 1 county that has lots of other problems & the county is geographically small & on the state line so there's not big costs w/ moving out of the county or state. www.wweek.com/news/2024/04...

You can go and read Blackstone. Commentaries came out during the revolutionary period and has basically been the foundation of American jurisprudential thinking from then until about the early 20th century. It does not make that argument.

In the 80s, just seeing something was on Slash records was enough to shell out a considerable sum of money. Odds were you never heard anything about the record at all. It could be Pogues, or Wreckless Eric, or Rachel Sweet or Lena Lovich. You had no idea what it would sound like or what genre.
