since commander-in-chief is within the "conclusive and preclusive" authority of the president, and therefore all his actions pursuant to c-i-c powers are entitled to absolute immunity, trump would've been better off ordering the military to take congress on january 6 than riling up a mob
He could also have the military execute any judge or prosecutor or witness in any process against him over stuff he did outside of his function as president.
He could also have them kill political opponent, e.g. every senator not voting for what he wants.
I think he would have done so if he thought Milley was loyal, would have accepted the pardon, and could guarantee the result.
Next time he'll have more confidence in his appointees and the military personnel he maneuvers into place, and they'll be more confident of their legal cover.
Alternatively, he could've done a quickie mass-commission of all the people at the pre-riot rally as 2nd Lieutenants in the Army, that way he could've told them outright to go kill Pelosi and Pence etc., and still would've been immune.
