under the opinion in trump v. united states there was no need for john yoo to come up with an elaborate justification for torture. george w. bush could have ordered an interrogator to crush the testicles of a child, no questions asked.

Really good thread analyzing results of posting the same client science analysis on Twitter, Threads, and BSky. TLDR: BSky has the highest engagement and Twitter comments were almost pure climate denial.

I don't want to sound too patronizing! If you want to create the public support for a future Dem trifecta to term-limit the court or expand it, go ahead. The dream Dem scenario for 2025 is another 51-49 Senate - GOP picks up WV, Allred beats Cruz, no other flips.

Things are going very well when we've reached the "Don't worry, the military won't obey orders to kill civilians" stage of democratic backsliding. It's the sweet spot, where good things happen. Right where we want to be.

I was and remain HIGHLY critical of how they handed Dobbs but also have come to realize that they just are generally slow. took them a few days to roll out a response to Trump’s conviction too. less than ideal but I’m gonna wait and see where they land in the next few days

i think this is right as far as it goes, but illustrates why his posture on court reform, ethics investigations, etc, is inadequate. the norms-respecting response to this insane power grab is to put together a package of legislation to reinstate the proper constitutional order, not "do nothing"

i think we should see the Trump v. United States ruling as a group of Republican apparatchiks taking their opportunity to vindicate Nixon and write the unitary executive into the Constitution. www.nytimes.com/2024/07/02/o...

will any of the feckless idiots who have over the years repeatedly assured us of John Roberts' nobility and seriousness of purpose devote their next column to explaining how they came to so thoroughly misunderstand the precise thing their job is to understand, or nah?

Think about the baselines here. Taney inherited a vile political system and dedicated his career to perpetuating it. Roberts inherited a system that, although flawed on any number of dimensions, sought to uphold a modest version of democratic equality. He's dedicated his career to dismantling it.

i don't know whether AOCs call for impeaching the justices will be the right one (it doesn't have a chance in hell of getting through), but the conversation has to start with congress, who are prime offenders in letting the court get to this point, and i'm encouraged someone there recognizes that

on top of addressing the lawless corruption of the Supreme Court, I think this is necessary a better Court could overturn this decision, but the danger of a President imbued with the power of a dictator at the whim of the Court is too great and must be explicitly rejected in the Constitution itself

since commander-in-chief is within the "conclusive and preclusive" authority of the president, and therefore all his actions pursuant to c-i-c powers are entitled to absolute immunity, trump would've been better off ordering the military to take congress on january 6 than riling up a mob

reflecting on the immunity decision a bit, what the Court seems to be saying is that every element of the executive branch is at the President’s disposal, no matter what he wants to use it for. his motives don’t matter. the office is a weapon to be wielded however he sees fit.

On page 8, Chief Justice Roberts decides that no prosecution of the president can be premised either on a use of the pardon power or on the firing of an executive branch official (like, say, the Special Counsel investigating the president).
