Prediction: Trump will argue that his NY conviction must be overturned because the court admitted evidence of conversations he had with his staff while President in order to prove knowledge and intent. He will argue those conversations were “official acts.” Judge Merchan and higher NY courts …./1
I know we're all focused on legal maneuvering, but it feels significant and important that Trump will be stating his official Presidential acts included ordering his personal lawyer to commit crimes with his personal company and pay hush money.
/2 ….will reject the argument based on finding that those conversations were not official acts and that including it was harmless error.
Trump will appeal from NY’s highest court to SCOTUS.
I would ask to predict the outcome but nothing makes any sense any longer other than accepting the most untrustworthy outcome is the most reasonable expectation
This sounds right, but Trump is and will remain a felon for quite some time under this scenario. I hopeful that Trump will be fighting more than one new indictment by the time his Supreme valets can get this conviction dismissed. Let the wheels turn slowly in our favor for once.
Did Trump preserve this issue for appeal? It obviously won't matter if he didn't, but I want to know how much the coming opinions will raise my blood pressure
I'm just reminded how Rick Wilson coined #ETTD back in the day, and I kept thinking... 'ya know, 45 is touching the whole USA. Here's hoping it doesn't die as well'. Whoopsie, RW is a prophet.
Trump’s lawyer made that explicit argument this AM to @steveinskeep.bsky.social, citing the court decisions that held his social media feeds are official communications so he couldn’t block people, hah hah hah.
How ironic. Trump was all over it when the Central Park Five used their fancy lawyers to get off on some technicality, and now he's doing the same. Except in this case a vacated verdict would actually imply that he's actually innocent.
