That's fair. I'm just trying to parse why this case and this issue and not others they have declined. And the but-for analysis is straightforward. But for this politically unpopular diagnosis, these patients could take puberty blockers and hormones.

We are awaiting an en banc decision on the 8th circuit case, that must people here expect to follow Skrmetti. And I have some hope there is enough evidence of bad intent to decide this on rational basis under Romer. And because it's EP, it's not vulnerable to the history and tradition nonsense.

I am hoping that it is significant that the Court granted only the US government's petition and only the EP and not DP issue. There may also be enough animus evident in the legislation to fail rational basis comfortably under Romer. We'll see, though.

Holy shit Missouri’s court of appeals does the right thing, rule school district discriminated against a trans male in dividing him to use the men’s restroom & locker rooms. It’ll be appealed to the MO Supreme Court of course, I probably shouldn’t be hopeful.
