I mean, that last sentence is a disqualifying-from-writing-about-the-current-federal-legal-landscape sentence. Also, why are people suspicious of experts? Goose-chasing-demanding-answers-dot-gif-dot-why-are-they? It's not just some sort of exogenous thing they feel.

Fun(??) fact: There are no native earthworms in MN; all are invasive species from Europe and Asia. (I learned this while trying to figure out how to identify "jumping" worms, which are both gross and harmful.)

what even is "qualified" here anyone who has ever held a job knows there are like 15 different ways to be really good at a job and people are exceptional in wildly different formats at the exact same task and anyone who doesn't get that has not actually worked and shouldnt be weighing in on work

Those familiar w founding era descriptions of the presidency will note TONS of references by Roberts in US v Trump to pres. "vigor" and "energy" but virtually none to ACCOUNTABILITY. Which is funny bc the Roberts Ct. loves to appeal to accountability to justify presidential pwr in other contexts.

How often will the current admin refuse to defend a rule enacted under a prior admin? When that happens, courts can appoint amici to defend the rule, but I think this dynamic will still matter.

Back in 2006 Andrew Siegel wrote an article called The Court Against the Courts: Hostility to Litigation as an Organizing Theme in the Rehnquist Court's Jurisprudence. Now I think we can say whose ever court this is -- is it still a Roberts court? -- it's a litigation promoting court.

Just adding that there were also statute-specific lines of cases - e.g., b/c the NLRA is relatively open-ended, the Court directed deference to permissible constructions by the NLRB. (These cases then got more-or-less folded into Chevron deference)
