President Grant got arrested for horse-racing one time in downtown DC. Got caught one day, promised he wouldn't do it again, and got caught the next day. Was going so fast it took his horse a full block to stop. He paid the ticket. Sucker!

Reading Justice Barrett's majority opinion in Murthy, it's striking just how lazy the 5th Circuit was. They knew who they wanted to win, and so it didn't matter that the plaintiffs were blaming defendants for stuff that happened too early, or was initiated by other defendants.

Bear in mind that Fani Willis so believed in Nathan Wade's judgment that before she selected him to head up this RICO prosecution it was his job to interview all the employees at the Fulton County DA's office and decide who stayed.

If you request the mistrial, you waive double jeopardy unless you can show the state deliberately provoked the mistrial. That's a trial court decision that gets a lot of deference and most judges won't make it against the state.
