Gonna get back on my hobby horse to remind folks the point of the second amendment was to prevent the federal government disarming slave patrols in the slave states, not to prevent states regulating private firearms (which they did)
Not just slave patrols. Also intended to stop the federal government from preventing settlers from taking over Indian land to the west, as the British had done. Militia was also intended to protect treaty-breaking land thieves.
Yeah, if you want to tell a story of individual gun rights against the states, it HAS to be a Fourteenth Amendment story like the one Amar tells
You just will not find anything like that in 1791
but some very self-confident people on social media have told me over and over that maintaining african chattel slavery played absolutely no role in the creation of the 2nd amendment.....
And we're in this particular mess largely because we had to be sure the states wouldn't immediately strip black people of their rights.
Slavery is our original sin the consequences of which we can never completely escape.
Strong disagree. Northern states without slaves were onboard with this because of deep distrust of having a standing army (fear of a military coup) and seriously misplaced confidence in the efficacy of virtuous citizen yeomanry defending the Republic, despite a mediocre war record.
