its not wrong because the hypo was presented to defense during oral arguments and they said "it could be an official act, and thus immune"

sincere question: would the seal team 6 hypo be less worrisome because Congress has the explicit constitutional power to create rules and regulations for the military, so it's a shared area of power, not merely a sole and exclusive Presidential power like the pardon is?

Sotomayor's hypothetical is wrong simply because the conservatives can't fathom it happening? Or the hypo is correct and they think it's a virtue of their ruling (the Trump briefings kept harping on the possibility of charging Obama with murder for the al-Awlaki drone strike)
