All it takes is a few independent, fair-minded judges. That’s about the same as subject matter expertise, right?

I've settled on this position and affirmatively think Biden should remain in the race come hell, high water, or his own death. The utter panic everyone has felt is not a sign that Biden should resign but that the moment when the election is *real* and its outcome uncertain has arrived.

I’m speaking only to the idea that voters at large will be upset by a lack of Biden back-and-forth style interactions in the days immediately following the debate. Not trying to make any statements about how voters feel about him overall, which is generally known already.

This feels like one of those times that those of us who religiously and obsessively follow politics may view it as malpractice, whereas the rest of the voting country won't even notice. My guess is it the delay until this Friday won't really matter to anyone but politics junkies.

As I understand it, one of the ways to prevent gentrification is to promote development of luxury housing in high demand areas. Give folks with money places to live in desirable neighborhoods, and they won’t gentrify [working class neighborhood]. Too often housing is not viewed in the aggregate.

And along pch in places like Del Mar and solana beach. Caravans of weirdos flying trump flags, blaring car horns, and driving in groups to.. make a point?

How funny—I am also (re)playing DS with the goal of building every single road. I'm going to be Eisenhower. I will connect this continent! Building those roads is time consuming work, but for whatever reason, it is the most fun part of the game to me. Aaaand I'm 37.

Because Julian Assange is not the whistleblower he likes to make himself out to be. He and Wikileaks were a dangerous—and partisan—mouthpiece of the Russian government. And journalist? He and WL irresponsibly leaked troves of unredacted documents—something no journalist would do.

Things tend to be "damning" or "damaging" because they are made that way by interested parties. Rs are great as this, as you've pointed out. D leadership missed a million opportunities to make hay under Pelosi's speakership during many of the Trump years. It hurt to watch.

Outstanding writing, as usual. You have beautifully laid out what is at stake with your characteristic style and clarity. There are many highlights, but I especially enjoyed the closing paragraph.

Interesting that it published faster than the normal 18 months. They have to select that at the time of filing.

Holy shit is this ever a good brief. Fantastic work by an amicus making all of the important practical points about content moderation with verve and punch. Gabriel Lattner is a goddamn stud

An honor (?) to have my tweet featured in this amicus brief explaining the importance of content moderation on social media. Glad that reply was taken down! www.supremecourt.gov/DocketPDF/22...

This article was fairly dismissive of trumps legal woes. I understand the pessimism, but I don’t think his legal troubles can actually be hand waved away as easily as the article asserts.

My prediction is that she orders him remanded to custody immediately after trial if he is convicted (and I do think he will be convicted), on basis of pretrial/trial conduct and risk that he commits a similar crime in 2024.

The TMEP requires that use of a mark in commerce is lawful. Sch. I ≠ lawful. Sch. III = sometimes lawful! I suspect it will get a lot easier to reg, but there may still be hurdles to establish the use is "lawful" rather than a mere rubber stamp process.

👀 Looks like the gov't is asking for some sort of redress for Trump's daily posts about the federal insurrection-related case.

This morning, former President Trump announced that he had received a target letter from Special Counsel Jack Smith in the Jan. 6 investigation. @benjaminwittes.bsky.social discusses what receiving a target letter means for Trump and what inferences can be made.

In reality, reform, or the credible threat thereof, is the most responsible, institutionally minded, and possibly politically galvanizing course of action—three cheers for checks and balances!—but it requires a political party and leadership that's resolute and primed for battle.

The reason I think that is that the long-standing arguments *against* it (fear of backlash, or perverse consequences) no longer have any validity.

My fuller thesis is that the time has come for Biden to stop treating court expansion as a political action to be avoided, and discuss it instead as a form of checking and balancing that the court has forced him to consider.
