If the Court is not 9-0 against absolute immunity, either the Court needs to be rebooted or the Constitution needs to be rewritten. Even one justice who favors absolute immunity is crazy and should not be tolerated.

I don't think the current court cares what is actually in the Constitution. A new slate of justices sound great. But who would nominate and confirm them? Because the people who would do that also are horrible and need replaced.

It’s also just clearly partisan. If Obama and Clinton had teamed up to block Trump from taking office, I doubt Alito would have been so chill about absolute immunity.

I am not aware of any process of “rebooting.” Given how split the country is, there is zero percent chance of the relevant constitutional amendment happening. So, we’ll need to figure out what to do within the system we have. Re-electing Biden should be our first priority.

Any way any how the court agrees to special immunity for Trump, it's definitely time to take the gloves off. The court is declaring war, and democrats need to stand up to them. Even if that means stacking the court or not adhering to the rules. If they don't do it, then we have to.

I agree with you entirely, but also think we're going to see the Court take this as an opportunity to restate the policy/operations distinction and say that the President is immune from prosecution based on policy, but not from prosecution based on the methods chosen for implementation of policy.

Seems like a bad move to grant a president total immunity who could press a button and have you killed. Clearly you want the president to have wide latitude to do his job without worrying about prosecution but there has to be some kind of guardrail to executive power or you just have an emperor

If the ruling is for absolute immunity, Biden could “reboot” the Court with extreme prejudice. I think the President being able to… bring a Justice’s term to an end, shall we say, undermines the separation of powers but I guess that’s why I’m not on the Court.

They should impeach any justice who votes for immunity. Yes it'll fail but some signal needs to be sent that these guys (and that party) is totally off the rails. Let Alito be the one in the hot seat for once, justifying his position.
