I'd like to replace the SCOTUS with the Kansas Supreme Court, please and thank you. #ksleg

But it won’t be enough if we don’t get another Dem governor after Kelly. Pessimistically, Kansas reproductive rights have another two years of safety. Optimistically, voters will engage & officials who oppose basic freedoms will face swift & dramatic political demise.

KS Dems have a good shot this year to remove the R supermajority. That’s a good start at protecting some of our rights & good policies. #ksleg

The people rejected a constitutional amendment to remove the state const right to bodily autonomy for abortion. But the legislature has many tools at its disposal, including pressuring the SCoKS in various ways.

The court can overturn itself. Two SCoKS justices are over 70. Governor Kelly has only another 17 months in office (she is term-limited).

A good day, and a reality check: Kansas abortion law rests on a 2019 case, Hodes, in which our state supreme court ruled that the KS constitution includes a right to bodily autonomy. That decision could change—live by common law, die by common law.

Dear #KCMO, I love you but not your teen curfew. At least this is the last nite we’ll have to pick our 17yo up from work at 11:30 pm to make sure he’s not inadvertently “loitering” on the way to his car

(I realize KCPD isn’t focusing on the theater kids after Shakespeare fest but why court trouble)

I don’t really mind the idea that agencies need to be strategic, develop their proof, etc. But in The Current Climate we are going to see the stupidest battles of the experts there have ever been

I guess as a practical matter, if you have binding authority from the appeals court you’re in, you don’t just rely on it; you start by arguing why the court should follow it

My question: Is horizontal stare decisis just … dead? Will the federal appeals courts still consider themselves bound by prior decisions? Will the state courts follow the federal? That would be a profound change to the way we understand common law, both substance & procedure.

This does make it easier to teach. Used to have to introduce students to the contradictory idea that SCOTUS is bound by its prior decisions but can also overturn them in some limited circumstances. Now it’s a lot simpler, no more horizontal stare decisis at the Supreme Court

I think all Latin Americans were freaking shocked when he said that migrants were usurping black jobs. As if they were the only ones available for those jobs! That statement implied a hierarchy where some are 2nd-class citizens and others are even less.
