The people rejected a constitutional amendment to remove the state const right to bodily autonomy for abortion. But the legislature has many tools at its disposal, including pressuring the SCoKS in various ways.

The court can overturn itself. Two SCoKS justices are over 70. Governor Kelly has only another 17 months in office (she is term-limited).

A good day, and a reality check: Kansas abortion law rests on a 2019 case, Hodes, in which our state supreme court ruled that the KS constitution includes a right to bodily autonomy. That decision could change—live by common law, die by common law.

My question: Is horizontal stare decisis just … dead? Will the federal appeals courts still consider themselves bound by prior decisions? Will the state courts follow the federal? That would be a profound change to the way we understand common law, both substance & procedure.

This does make it easier to teach. Used to have to introduce students to the contradictory idea that SCOTUS is bound by its prior decisions but can also overturn them in some limited circumstances. Now it’s a lot simpler, no more horizontal stare decisis at the Supreme Court

I think it was basically Skidmore "deference" which stems from a 1944 case. I'm not sure if it's really deference when the test is "courts defer when the agency is persuasive in its reasoning", but nevertheless. constitutioncenter.org/blog/how-the...
