After the Court’s decision yesterday, I think there’s an argument from necessity for Biden seizing Trump and trying him by military tribunal, given the sudden unavailability of Article III courts. Plus, itʼs just the sort of thing they’ve authorized an active and energetic chief executive to do.
There's an argument for anything now, but he won't do it. I wish I found that admirable but I'm scared of what's going to happen in November with the way some people who should know better have been talking. It's like everyone is sleepwalking towards a cliff.
My thoughts exactly. Biden comes out with a "I will head this up to save our republic bc of the untested waters we are in, this is my last act as president" and then he steps down and we move forward with Harris
Look, I don’t much like my pro-carceral self when I get fearful and mad. But: why are you thinking in terms of trial? For the due process? For the looks? DJT is a clear and present danger. An active executive removed the danger. Why not just jail him? Why not just torture a confession out of him?
They could’ve done countless things to prevent the court from even reaching this decision; it’s naive to think that *now* is when Dems will act.

While I think that would certainly demonstrate the danger posed by a chief executive unbound by law, I think you could kiss any chance of Biden winning the election goodbye.
Disregarding the slim possibility, is a President(who is a civilian, not a member of the military) even eligible to be tried by a military tribunal? Or does this just operate under "the law means nothing now", so go for it?
That is my thinking, too. The SC went out of its way to proactively empower Trump and subject us to his worst instincts. Does Biden have a responsibility to use (no, abuse) that power instead? I wish I was kidding, but I’ve been thinking about it for the last 24 hours, like, a lot.
There's an even better argument for Biden ordering the extraordinary rendition of several supreme court justices to undisclosed locations. The remaining three justices declare 28 USC 1 (requiring six-justice quorum) unconstitutional and overturn Dobbs, etc.
Much as Obama really dropped the ball by not raising the alarm that Trump was being investigated for Russian ties in 2016, though he legally could, this just aint happening though legitimately necessary.
Definitely Biden should arrest and try Trump if Trump wins the election. He cannot be allowed to take office as a dictator and it will be Biden's responsibility to the country to prevent that.
At the rush of repeating myself, if we’re talking about this kind of thing would it make more sense to just declare that the popular vote will decide the election instead of the electoral college?
An argument can be made for the imprisonment of trump, until he accounts for the still missing national security documents he received and never returned.
If centrists were content to usher us into a fascist dictatorship, fine, they have their goals, it's what they do. But to do so while SCOLDING us and BLAMING us—that's what's especially infuriating at this precipice, and it's unforgivable.
