Not to be corny but I do think the ongoing aspiration to make America a pluralist democracy of equals is righteous, beautiful, and worth honoring, even if it has more often been the struggle of minorities & dissenters than the policy of the government. 🇺🇸

So the bench (and appellate bench) should take a cue from the defense bar’s playbook and beg for judicial nullification in the meantime. SCOTUS’s power has no effect if the rest of the judicial branch says ninny-ninny-ninny. Related thought: political enemies should stay out of the 5th Circuit!

It will take generations to replace the current court — and that’s assuming no bad actor ever gets elected. I also don’t believe Biden or his successors will have the political fortitude to expand the court. Nor do I believe a constitutional amendment is possible.

#1 👀 I’m less concerned about #7. Of course strident Democrats of Bluesky will vote for Biden regardless and apparently diss you if you even consider changing courses midstream). But people are forgetting a number of key voters who are likely turned off now (permanently: he’s not getting younger)

It’s cheaper to build housing than staff and build jails for the homeless. But because cities can bury those latter costs in law enforcement budgets that are almost never challenged by the citizenry, they’ll happily spend more. Housing has to be paid up front and the political hit is too much.

I was the only weirdo who liked it. But true. Because I was also taking environmental law (in 2020) I spent a lot of time preparing the attacks for the what-ifs on the final. We are now here. We couldn’t even stymie climate change WITH Chevron deference.

1/2 (or /3) Bluesky is full of people who understand what’s at stake and will vote for Biden regardless of almost anything because NOTHING is worse than a second Trump presidency (agreed!). So you can all rally and recommit yourselves. But that’s not recognizing the damage the debate did to:

Beyond the undecideds I worry that young people will not vote. It’s always a hard demographic to draw, but you can’t convince me they were inspired to flock to the polls.

A gay couple days they’ve been targeted by an Oregon city council member and his wife for more than a year. On the 7th incident, he had had enough. The issue exploded at last night’s council meeting. The councilor denies using derogatory language or lewd gestures.

In 1997, I covered the legal proceedings against a woman who was using her home illegally as a hospice. Was shocked to arrive to court and hear she declared herself a sovereign citizen. My first introduction to it.
