I think this (Martin v Boise) is why Columbus has recently been so vocal about how they talk to people in camps and offer them services. A lot of times it’s bs because the beds aren’t practically available. But they try to cover their a** by saying they have offered shelter.

But the laws applicable to encampment protests haven’t changed at all based on Grants Pass. Available shelter beds are irrelevant to protesting arrests.

My understanding is that cities outside of the 9th Circuit have tried to avoid doing sweeps when shelter beds aren’t available, fearing they would get sued under the Martin v Boise theory and lose. Without Martin, cities may now do more sweeps and arrests depending on their state and local laws.

that were open/available for those folks. The 9th Circuit had said it was cruel and unusual punishment to criminalize sleeping outdoors when the people essentially had no choice. This Grants Pass decision means those cities can once again criminalize homelessness even if there are no shelter beds.

I don’t think that’s the case. The decision basically just overturns Martin v Boise and means that each state’s law is the basis for how homeless encampments are regulated. What was so great about Martin was that it meant cities in the 9th Circuit could only sweep camps if there were shelter beds/

Great article, and very important subject. The law should evolve with the medicine, and medicine has completely changed what it means to have HIV. The laws need to be updated. They currently contribute to the stigma around HIV infection.

The fact that homelessness services exist in the Columbus Department of Development really speaks for itself. But this is a perfect storm of problems. The city can throw its arms up and be correct, in a sense, because the housing just isn’t there.

The most infuriating part to me is that the CSB is paying hotels with active environmental court cases with city funding. The city is arguing these places are unfit to live in while also paying for people to live there.

There is no affordable housing readily available in this city. CSB knows that, but they (and other orgs) provide these lists of landlords or property management companies as a way of washing their hands of the problem.

Yeah I think the story is really that the racist lady’s stupid realtor decided to tell Raven she wanted to back out. He should have given the lady a lecture on the law with a disgusted look on his face and then told her to sell or he would walk. It’s a realtor’s job to tell clients the law

I’m just saying tweeting does work in Columbus, and because we don’t really have democracy (candidates are chosen by the D party), negative publicity is often the only thing that works. Our council is young by design, I think 8/9 of them are under 50.

Usually. But if elected officials read your tweets and feel shame because of them, they can be pretty effective. No city electeds in Columbus, Ohio care if I vote for them but they do get annoyed when I tweet about their bad policy decisions

I guess because it puts the burden on the applicant, a person they can pursue for fraud, rather than a document which people can claim was a misprint, accidentally submitted, or that the office workers misread it. It’s all about making sure they have someone to sue to recoup fraudulent benefits.
