The question of what "the founding generation" thought about executive power is immensely complicated. What Thomas is doing here is not "originalism" in any meaningful sense, it's just history a la carte. It's "living constitutionalism" as done by pro-Trump judges.

Paine helped draft the Pennsylvania Constitution of 1776. That constitution created a 13 PERSON EXECUTIVE because the people who wrote it were anxious to constrain the power of that branch. It's the exact opposite of Thomas's "unified executive" theory. avalon.law.yale.edu/18th_century...

I think a big part of Trump's appeal to conservatives is the promise that you can completely disconnect from observed reality and just say and do whatever you want. He gives them total license to live in the Fox News paranoia dream world

The idea of “PhD level intelligence” is very funny to me, personally, because I have worked with scientists for 20 years. I know someone who has helped find treatments for diseases we didn’t even think were possible and also struggled to understand how the hot tap of a water cooler worked.

Texas’ GOP calls for an amendment to ensure Republicans always win statewide elections by requiring candidates to win a majority of counties. Texas has 254 counties. Half its population lives in just 7 of them. Trump won 232 of counties, but the 22 counties Biden won contain 58% of Texas residents

We do, yes. Part of the reason we’re all getting trained is to enable any full time FH faculty member to teach it, if needed (and to better incorporate it into our other core classes).

6th grader is working on her end-of-year group report on the American Revolution. “Dad, all we find in books is stuff about the ‘Founding Fathers.’ What was everyone else doing?” She’s now framing the report around Abigail Adams, Deborah Sampson, Harry Washington, and Thayendanegea (Joseph Brant).
