No criminal defendant — however innocent — wants “his day in court to clear his name.” Juries are unpredictable and anyone facing a felony conviction would much prefer to avoid a trial entirely! Let’s not forget everything we know about criminal law just because it’s Trump.

Today the New York Times ran an 1,800 word puff piece portraying Erin Hawley's efforts to ban abortion as consistent with her lifelong opposition to invasive government regulations.

This idea that the government cannot complain to the media about inaccurate stories is a completely made-up thing, much like most of the conservative judicial philosophy (the major questions doctrine, the Second Amendment individual right to bear arms, the attack on the administrative state).
