And every time BigLaw #resistance lawyer Neal Katyal makes an appearance on MSNBC, remember his similarly fawning endorsement of Gorsuch.

The experience with judges standing up to executive abuses under authoritarian regimes is… not encouraging. (See, e.g., Hilbink, Judges beyond Politics in Democracy and Dictatorship.)

This strikes me as correct. The exclusionary rule the court announced (i.e., pulled out their arses) will undoubtedly be used to create mischief in the NY case.

"If MoMA is going to get serious about this world, it needs to start by dumping the whole concept of 'Latin America' and start getting specific."

I write about a show that has been irritating me for a hot minute.

“How to Design a Revolution” was such an excellent exhibition. As you point out, it was precisely because they went deep into a specific historical moment in a particular country in a way that’s not possible by treating an entire region as an undifferentiated whole.

i think we should see the Trump v. United States ruling as a group of Republican apparatchiks taking their opportunity to vindicate Nixon and write the unitary executive into the Constitution. www.nytimes.com/2024/07/02/o...

Americanists and lawyers ask, what does the Constitution say? Comparativists ask, who controls the High Court, the militia, and the clerics?

As always with stuff like this I think of Juan Linz and his basically correct conviction that the United States is a country determined to shed any accidentally remaining vestiges of parliamentary tradition and fully join its wider continent’s proud tradition of Authoritarian Presidentialism.

Absolutely wild that the court accuses the dissent of "fearmongering" with "extreme hypotheticals" when the actual basis for the indictment is a coup attempt that led to an attack on the capitol

“The campaign isn’t over yet. But we’re at a fork in the road. It feels a bit like leafing through one of those old Choose-Your-Own-Adventure books, except every branching path somehow ends with ‘and then an ogre devours your skull.’ Every option from here is risky, and the stakes are existential.”

There is a *very* sharp paragraph in Justice Kagan's dissent in Loper Bright on the dance this conservative majority has performed repeatedly to weaken liberal precedents en route to overturning them altogether -- on worker's rights, on the Establishment Clause, and on voting rights.

Also too: imagine if every NYT pundit used their valuable space this morning to call on Rs to ditch Trump for being held liable for sexual abuse, for committing 34 felonies, and for lying about literally everything. They could do that! They don't! I wonder why!

Biden is too old. But he has surrounded himself with competent people and has had a conventional first term. Trump is authoritarian but inept. He has surrounded himself with people he hopes will make him more effective at authoritarianism. Neither is ideal. But these are not similar problems.

Some quick takeaways on the failed "coup" attempt in Bolivia. 1. This was not a serious coup, meaning a planned one that enjoyed wide support among the military and had a strong chance of succeeding. It was more one general's claim of wrongful termination, backed up by a platoon and tanks. 🧵
