Kind of fun that after all this talk of democracy the justices basically amended the constitution by judicial fiat

This decision is definitely in line with this court's clear attitude of "we both decide and make the law", and it'll almost certainly get worse until they are actually forced to stop by either court expansion or by substantial composition change on the current court.

Griswold and Roe weren’t amending the Constitution by judicial fiat? They explicitly invented a constitutional right based upon “penumbras” and “emanations” arising from provisions actually in the Constitution.

All the people who tediously proclaim "the U.S. is not a democracy, it's a constitutional republic" now want to "let the people decide" whether or not a constitutional disqualification should be applied.

A gentle reminder that none of this would be happening now had Comey not released that letter and Hillary had campaigned a little more in Michigan and Wisconsin. Also might have been nice if Ginsburg had retired before dying.

Our only hope is that there is an 8-1 decision on presidential immunity coming our way. Otherwise, it’s going to take a while to get a majority of 67 Senators to dismantle the High Court.

Not the job of the state to keep ineligible people off the ballot. Leaving open the question, who is responsible for being sure Trump is not sworn in if he wins the election? Trump can only be eligible with a vote if 2/3 of both houses of Congress. Court has set up a Constitutional crisis.

The Constitution has always said whatever the Supreme Court says it says. The actual words have never meant anything. Not a new issue; I remember talking about it in college decades ago.

The Supreme Court justices are now legislative activists. They are not considering the constitution and established law in making their decisions—but remaking laws to support their decisions. We must reelected Biden and then Biden and the Senate must “pack the Court” with four more Justices.

Colorado should respond by quoting the advisory opinion alongside the findings *from the majorities of both houses of Congress* that the subject engaged in insurrection and is thus disqualified from office. Republicans realized the court only has the power we allow it. We should apply this lesson.

love to say 'the constitution doesnt say this is a state power' - even though it kinda does - and then immediately whirl around and say 'this is def congresss job' - even though nothing in the constitution says anything of the sort
