Also I would have expected them to game this out a little further and realize this is putting a sword at your own neck. If Trump wins and you piss him off at any point for the rest of your life you're going to be arrested or worse and good luck drawing a distinction about official acts then
Yea, same. I also thought they had respect for—and would protect—their own power as an institution.
I’m surprised they were willing to disarm themselves so quickly
I'm not from the US, so don't know what they're like. But could some of them just be more worried about what'd happen if they don't support Trump now, than what he'll do to them in the future?
Yeah, if trump wins, the Supreme Court loses all its power. Only dems are obliged to respect sc decisions—they just gave trump permission to ignore them. They either rubber stamp what he wants or he replaces them (or gets rid of the court altogether). I’m not sure they really thought this through
Reminded of the slaveholders who rebelled to continue holding slaves but then would not offer either the laborers or their output to the war effort at its most crucial moments
It's ironic how much conservatives love the Roman empire, because in this one case it is very useful. If you give an autocrat power then the political class will be bled dry over about a lifetime. Between Sulla's dictatorship and Augustus's every major family but the julii were ousted from power
I actually don’t think this is the case bc, ultimately, who is going to decide what an official act is, and the presumption has been overcome?
This is another expansion of Judicial power clothed in an expansion of executive power.
One thing is clear: they have some kind of plan to keep Democrats from ever winning an election again. They wouldn't dare do this, or their Project 2025 thing, if there was a possibility that their opposition could play by those rules.
Maybe that’s why Roberts joined with the others? He seemed most interested in “respectability” but if the ship is sinking, might as well make sure there’s room for him on the lifeboat!
Biden had a duty to make them instantly regret this decision and reverse it, but instead he said he'd reward them by behaving like they made a different decision, then let Trump wield absolute dictator powers against those of us who were foolish enough to fight for Biden.
If I underhand correct, the legality/illegality of a Us president's actions are now subject to that same Supreme Court, so it could be very well be that this is the party, or the "justices" themselves putting a control on Trump: "You do what we allow or else you go to jail."
I've kind of resisted comparisons to Nazi Germany before this, but this feels like a sudden lurch in a direction with a lot of specific historical resonances, and from a pure self preservation perspective this is not only feckless but stupid by the court. They think they can ride the tiger.
But, maybe we shouldn't be looking at Trump. He is 78, obese, addicted to McDonald's, and rapidly descending into dementia. He's as likely to keel over before his next term ends as Biden is. We should probably keep an eye on who Trump's VP ends up being.
At least now we can put to bed any arguments about whether liberal justices should retire because if Trump wins he's just going to disappear them all anyway and it's a 9-0 rubberstamp court forever
