Another good Emergency Message out of SSA this morning, this time related to the new rules on Past Relevant Work they published a couple of months ago. Of all their recent regulatory changes that one is the most meaningful in terms of people getting approved for benefits more easily.

Because what is the difference between a 601a waiver and a 601a waiver w/ PIP?
They are basically the same benefits wise.

So now I filed a Petition For Review of the interlocutory appeal. Jurisdiction stripping clause generally interpreted to prevent review of such appeals by the Cir Ct. I think there’s an exception here but the DOJ, instead of looking at the v wrong decision & agreeing to address it, moved to dismiss

Update: had to draft a writ and complaint for federal court, get the AUSA involved and threaten to sue and threaten a TRO petition
Now DHS says they’ll stop their deportation efforts *for now* “while they assess the situation”

To be clear, I already replied as I had the cite to hand because I’ve done detained work for ten years now and I’ve memorized when stays automatically applies (not a boast, anyone practicing in detained removal defense should know the stay rules roughly or know how to find them quickly).
