I took a specialist bar exam and honestly real specialist stuff is doing like a law clinic or similar thing and assessing a pro se complicated case quickly and providing meaningful advice that a lay person can benefit from

I had a half hour conversation about the correct way to file an asylum application involving an unfiled NTA, no pending immigration court case, and a USCIS rejection citing lack of jurisdiction And yet people are expected to navigate this by themselves

I want to get real nerdy about the new immigration EO but I don’t think enough immigration practitioners made it over. Because what is the difference between a 601a waiver and a 601a waiver w/ PIP? They are basically the same benefits wise. What am I missing?

So now I filed a Petition For Review of the interlocutory appeal. Jurisdiction stripping clause generally interpreted to prevent review of such appeals by the Cir Ct. I think there’s an exception here but the DOJ, instead of looking at the v wrong decision & agreeing to address it, moved to dismiss

Jurisdiction-stripping clauses are the government telling you that they plan to engage in unlawful and unconstitutional conduct Working on a case with a defective Notice to Appear and inapplicable removal grounds. Imm Judge wrongly denied the motion to terminate, Board upheld the Judge wrongly too

From my South Dakota colleagues--a faculty member at the USD is being threatened with termination if they don't remove their pronouns and tribal affiliation from their email signature. The Board of Regents previously passed rigid guidelines on what an email signature may contain.

Update: had to draft a writ and complaint for federal court, get the AUSA involved and threaten to sue and threaten a TRO petition Now DHS says they’ll stop their deportation efforts *for now* “while they assess the situation” This regulation is very clear and not at all ambiguous This is silly

To be clear, I already replied as I had the cite to hand because I’ve done detained work for ten years now and I’ve memorized when stays automatically applies (not a boast, anyone practicing in detained removal defense should know the stay rules roughly or know how to find them quickly).
