I should clarify: I think it’s highly unlikely that we start throwing the book at powerful people for rel minor crimes like falsifying business records (as opposed to, e.g., public corruption or crimes involving use of power or position of trust to harm others) while lowering sentences for others

I was also trying to provide context re Gertner’s specifically, as she is someone who does in fact spend most of her time arguing for lower sentences for non-powerful people, unlike those who like harsh sentences or don’t talk about a need for more leniency except when someone powerful is at issue

It’s true that these args are often weaponized. I think Trump should be jailed for the false electors scheme and the insurrection. But I think jailing more people for falsifying business records makes it harder to lower our overly punitive sentences for other crimes, including violent crimes

Not necessarily an arg I agree with but isn’t as outrageous as the args that former presidents shouldn’t be prosecuted/jailed. Would raise real const’l Qs to have someone elected pres while in jail for state crimes, & this is a relatively minor one, which arguably makes it worth avoiding those Qs

Overall it seems like her arg is that it’s not normal for defs to get jail time for this crime, & although he is worse in several ways, jailing him for crimes others usually aren’t jailed for on the eve of a pres election he might win raises sufficient problems to outweigh those aggravating factors

I agree this is problematic. The orig post was about her not knowing enough to comment on his sentence, which is silly, and did not include this part or link to the piece. It seems clear that she thinks Trump was rightly convicted but the poss of him becoming president while in jail is a factor

Exactly, that sentence is just boilerplate. We all know enough to discuss his sentence. And while I don’t like the arg that the poss of him becoming pres again soon should be a factor, the fact that her background position is that all defs should receive highly indiv’d sentences seems relevant

My point is that she supports more lenient sentences in general and is writing from that perspective. She provides this boilerplate caveat whenever she writes about an individual sentencing. This isn’t just someone making exceptions for Trump.

Hot take but I think prosecutors should try not to fuck up really important cases by, for example, introducing testimony that could be grounds for a mistrial or reversible error on appeal, or having affairs with their special prosecutors

If I were in a position like that a big-picture question I would ask myself regularly is “do our readers come away from our coverage with a more or less accurate picture of the world” but I guess I’m a big dummy because that doesn’t seem to be a benchmark for these types of people at all
