It's so off-the-charts unimaginable that we're indeed all having a hard time processing this information. That's why we see the lawyers trying to interpret it differently or to minimize it: because it's truly hard to believe the corrupt justices would go that far. And so now what?

It's really hard to wrap your brain around the idea that the US Supreme Court just unilaterally amended the Constitution to immunize the first president who tried to unlawfully retain office after losing the election. That's what actually happened, not some alarmist fever dream.

Heritage is apparently already planning the legal fight to keep any possible Biden replacement off the ballot in battleground states. One win in one key state court, and the election is literally over. The replacement idea was always terrible, now it's clearly fatally toxic.

Honestly, as someone who fought for and benefits from Obegerfell -- truly, pretty far down on my list of concerns about this Court and this moment. The structural damage to the institutions, on the other hand, and the destruction of the rule of law? Fundamental to all of us.

I teach an undergrad class on amending the US constitution and include comparative stuff looking at state constitutions and other nations’ constitutions. Students are encouraged to look for model formulations in other contexts. So informative, and always makes me wonder why I wasn’t taught that way.
