“The Court’s conservative majority has revealed itself to be the most direct threat to American democracy, and any Democrat who is not ready to shelve old fears about ‘court packing’ and get serious about expanding and reforming the Court isn’t made for this moment.” Correct.

I’m almost in awe of the Calvinball here. They get to say that he’s immune for official acts but not unofficial ones but not offer any defined test for what will be considered unofficial, so even when the case is revised they can just say “no those were official” and boot the case again.

If the lower court understood the present moment, this would be its response: "The court is surprised this needs to be said, but anything related to a coup attempt is not an official act. That includes all of the conduct in the indictment. Trial begins September 1st."

Opinion basically comes down to "official actions are immune, unofficial aren't" and the court says that since lower courts have not made a determination on that question, they need to go do that. Beyond me to determine how feasible that is, but absolutely delays the trial.

it feels like the whiteness of big political media spaces right now is having a big effect on how people are thinking about the debate. eg I have seen relatively little discussion of trump's "black jobs" comment, which immediately exploded on black twitter

A few years ago, Jon Lovett floated a theory that media treats Democrats like protagonists - to be challenged, accounted, and forced to be behave in growth-oriented ways - while the GOP are treated like antagonists - immutable, expected to disrupt, thematic obstacles. Thinking about that a lot.

So to recap, SCOTUS says: * We justices are the executive branch now * The majestic equality of the laws prohibits both rich and poor alike from sleeping under bridges * Obstructing the certification of the president after an election is, at least in isolation, very cool and very legal

1) fitting that Gorsuch, a notably cruel jurist, has the majority opinion here 2) another vindication of my view that the conservatives on the court are re-inflating the police powers of states to regulate public behavior and morality as they please

this idea that the bible was a significant influence on the constitution is obviously widespread but i've always been struck by insane it is. not that evidence matters to these people but if there's anything we know for certain about the 1787 convention it's that the bible had nothing to do with it.
