there are a lot of ways for the state to suppress dissident speech. one particularly bad one is by having armed agents of the state stand by and do nothing while partisan-aligned thugs or paramilitary groups beat you because of your speech, and then have the DA decline to prosecute the assaulters.
They couldn’t charge him because his defense would have been “yeah my homies on the police force called us up and told us to go beat the shit outta some libs” and if you don’t think that’s what happened you are very naive.
A great example of the problem with a formalist approach to civil/human rights (and why CRT is superior 😏). There are many circumstances where state inaction *is* action.
Wonder if my mom and her Facebook friends will be anywhere near as upset about this as they are about the migrant kids who beat up a cop and are gonna end up in jail even w plea deals but that's not enough suffering for them or whatever
this particular DA declining to prosecute is probably more complicated than that. He showed up and pissed off pretty much the entire DAs office and all the cops w aggressive, no-discretion policies banning all sentencing enhancements (legally questionable). He is as left coded as prosecutors get.
That's exactly what the black shirts, brown shirts, blackhundrists, integralista militias and so on, are for.
This is an old strategy of plausible deniability. The police doesn't need to beat up progressive protestors if there are thugs to do that for them.
