Medicare issues 3 major rules and a dozen minor rules every single year. They are each thousands of pages long and each part leans on the others. If you knock one out then none of it is interpretable. Now anyone can sue and send a big fuck you to every doctor, hospital, and patient in the country.

So what this actually does is say “now anyone can sue any agency in any district for any implementation of any rule” and you now have almost zero regulatory certainty and a patchwork of regional rules. Absolute chaos.

The two options here are that either SCOTUS 1) Have no idea how laws are actually written or 2) Don’t care. Congress says “Agency, accomplish this goal by this date and here’s how we’ll oversee your progress.” They can’t stop writing laws that way bc they aren’t all experts in everything.

Biden is too old. But he has surrounded himself with competent people and has had a conventional first term. Trump is authoritarian but inept. He has surrounded himself with people he hopes will make him more effective at authoritarianism. Neither is ideal. But these are not similar problems.
