Fighting for a legal system that works for working people (Executive Director, People’s Parity Project & PPP Action); Saint Paul; usually wish it was colder.

I know Joe Biden has bigger fish to fry right now, but I am thinking once again about his choice to form a Supreme Court reform commission that included no proponents of Supreme Court expansion, which (surprise!) quickly concluded that Supreme Court expansion was off the table

Hope the US labor movmt gets this - they will never get a fair shake from Roberts #SCOTUS who will always call balls & strikes in favor of their big business pals. Until Cong rebalances this right wing Court through reforms/expansion they will keep screwing workers yr after yr.

While we’re waiting for whatever fresh hell Friday brings, a reminder that the Court has already caused a bunch of harm this term. I wrote about one example of this for Balls & Strikes:

“Between the 1880s & 1935, courts issued more than 4,000 injunctions against strikes, picketing, & other collective action by workers; and struck down hundreds of worker-protective laws.” Courts’ hostility to workers isn’t new. It’s (long past) time to do something about it.

It shouldn’t require this much advocacy to get Democratic committee chairs to hold Republican justices accountable. Sometimes it takes the threat of a primary challenge.

There are many causes of this, but one is our general misplaced obsession with "The Feds," and as I've complained about a lot #onhere, every single law school is culpable in this.

"Con Law" classes are just FED con law, and "state and local govt" is a CLASS, not like ... embedded everywhere.

The current cowardly establishment take is that the nyc trial of Trump was unserious and the only legitimate things to try Trump for just happen to involve getting past the veto of federalist society stooges who would support a violent overthrow of the government if it meant putting Trump in power.

I hope people understand that what we are seeing is the systematic destruction of the civil war amendments by the Supreme Court, which are what made America and actual democracy and upon which all minority rights in the United States rely

It’s really, really hard to get the federal government to do the right thing. It would be cool if, when they actually do, we stopped giving pro-corporate, anti-worker courts the ability to strike it all down.

I wrote about the hell that is our juristocracy for Balls & Strikes.

Even the lessons of the BLM era seem to have immediately been unlearned. Less than four years ago there was emerging consensus that policing was a violent institution that we'd come to rely upon too heavily. Now it's "let's ask cops to get rid of these inconvenient protesters."

Not going there with age brought us Amy Coney Barrett and the end of a constitutional right to abortion. So, imho, yes, we have no choice but to go there.

Sonia Sotomayor has been a fantastic Supreme Court justice for 15 years. The best thing she could do to cement her legacy is ensure that a Democratic president appoints—and a Democratic Senate confirms—her successor.

I talked to Bloomberg about Sonia Sotomayor, political realities, and the fact that when the Supreme Court makes itself the ultimate policy-making body in the country, we don’t have the luxury of ignoring sticky questions about retirement.

It's bewildering seeing Smart Takes like 'not enforcing the Constitution is good bc Trump should be beaten at the ballot box: vote!' when the whole reason we're having this conversation is because we *did* vote, Trump *was* beaten, & he didn't give a damn!

• Former romantic partner of Maura Healey.

• Former BigLaw partner whose practice included defending corporations against consumer class action lawsuits.

This is not a good pick for the Massachusetts Supreme Judicial Court.
