Think about the baselines here. Taney inherited a vile political system and dedicated his career to perpetuating it. Roberts inherited a system that, although flawed on any number of dimensions, sought to uphold a modest version of democratic equality. He's dedicated his career to dismantling it.

Easy to lose sight of the significance here, but the sitting president just gave a speech condemning the Supreme Court for a ruling that expands presidential power. It’s also a president who stands to benefit from this ruling, given that his opponent is vowing to imprison him and his family.

My first proposal was to order some large proportion of the fleet of federal vehicles to park in the SCOTUS parking lots. Not all crimes are horrible, like assassination. Some are just petty, annoying ways of making it clear how crazy it is to give the President this much power.

When I taught Watergate last spring, I asked my students if they agreed with Nixon that "if the president does it, it's not illegal." Almost universally, they found that idea appalling and said that everyone has to be subject to the laws. My students understood the constitution better than SCOTUS

The only advice I’d give the Biden campaign is to go to war with the NYT. They’re even less popular than Biden or Trump, would form a good rallying cry, and reframes the campaign to be an underdog attempt to push good policy against elites who don’t want it. “NYT is for the billionaires, we’re not.”
