I love Slavic faerie tales; they’ll be like “there’s this creature that eats your feet if they dangle out of bed at night - also it’s a dead abandoned baby with the face of an old man that screams like a thousand mothers mourning their sons lost to war and it shits black rotting fish”

Labour’s campaign was extremely cautious, and given past defeats I understand why. But now the UK center-left has a huge majority in a system with many fewer choke points than in the U.S. Let’s hope they’re ready to govern like the dominant party they now are

i think akhil amar reed captures something very important, which is that the roberts court rewrote article ii, which explicitly states that a president can be held criminally liable after impeachment (and which has long been understood to mean that he can be held liable after leaving office)

this is one of my least favorite tropes and it is especially ridiculous when the heroes have just shot their way through an army of mooks to get to the villain oh, you can kill 475 henchmen but the guy who is actually responsible for ordering them around is a step too far? do you hear yourself?

the whole point is for law professors and lawyers to pretend that the law is a neutral process and not fully contingent on who is holding the hilt it has nothing to do with the law, it has to do with their denial about what they've dedicated their life to

Not that anyone particularly cares about original meaning, but think folks should still say it out loud: For all of the things that are unclear in the founding documents and unknowabilities of what the Founders intended, "the President can kill anyone or commit a coup" was *never* legally arguable

few people outside of the ones actually writing these terrible rulings bear more responsibility for our current state of being than RBG and furthermore, while I think she is easily our best active Justice, Sotomayor should resign and be replaced by a 45-year-old in perfect health by November

Separate but just as important. The president speaking in a official capacity is judged by the SC to most likely be immune. So using Biden as an example If he was to make a speech to the country doxing every Republic Justice's address and calling on Ds to "fight like hell" that would be legal.

I'm reading the opinion and it says he enjoys absolute immunity regarding threats to fire the attorney general if they don't do what he wants. So, he could easily just say "investigate or prosecute my friends and you're fired" and he's 100% immune, right?

Good point from Sotomayor here. By barring prosecutors from probing a president's intent, Roberts renders the entire "official vs. unofficial" distinction meaningless.

the decision lays out - explicitly in the case of the DOJ and implicitly in case of the military - that a president can order the prosecution of or a military strike on anyone he doesn’t like and fire anyone who doesn’t comply until he finds someone who will he may not be prosecuted for this

I really have lost my former tolerance for "we're doomed/fucked/it's all over/they've won" takes at this point, in that they're the most dangerous attitudes one could possibly have when confronted with a truly existential political threat (which we still DO have levers to address).

It's quite simple. Just because you can do your presidential duties does not mean you can convince people that you can. Being a presidential candidate and being a president are two different things.

I don't know if I'd go that far but I'm fully aware of how effective Biden has been. However, not everyone is terminally online like you or me and the average voter really doesn't know shit about what Biden has done plus they at the least dislike him.

Polls were even/down for Biden before an awful debate which if you're D basically automatically equals a loss. I'm not sure Harris is automatically the answer because she was very unpopular in 2020 but it's been 4 years so her polling #s could have changed.

It doesn't have to necessarily be Harris. It depends on what Biden would say he wanted his delegates to do. Also depends on how bad the polls next week are. Because if the polls are bad next week.

I want him to drop out because I'm not confident he can win the election anymore but the only way he drops out is if he decides to. There is no other mechanism to get another candidate in there. Also still voting for him in November if he hasn't dropped out.

almost the entire “should Biden be replaced on the ticket” conversation is about which choice (him staying or him dropping out for Harris) has the best practical chance to beat Trump in November “how to Not Trump” is the overriding concern

I will say I am actually very surprised and happy with the amount of work his administration has done on climate change and going after corporations. He's one of the strongest Democratic presidents on policy we've had in a little while. But he doesn't make me enthusiastic to vote like Bernie did.

Oh my god I went down the rabbit hole. "Why January 6th wasn't an insurrection". It's irrelevant what label you use. Trump full throatedly encouraged people to storm the capitol. Trump delayed deploying the National Guard. Etc. Don't care what label you use it was literally absolutely terrible.
