I would solve the federal judiciary's dilemma by offering to expand their capacity. Simply appoint 18 more justices (the president is strongly encouraged to choose his nominees from a list of judges recommended by a disinterested, nonpartisan expert committee) & randomly empanel 9 on any given case.
