The Ford pardon of Nixon would have been totally unnecessary. A million other actions and arguments in American history assume presidents aren't immune. It's a totally new idea, nowhere in text or American tradition. Arguably the least originalist major SCOTUS decision in American history.

It was very traumatic for Republicans to have Nixon resign in disgrace & then 13 years later have Reagan close to being impeached (what saved him as much as anything was an implicit "he's too senile to have been knowingly involved" argument). Partisan hacks like Roberts have never forgotten this.
