There's usually a dance to this process where a polite letter is sent before issuing a subpoena, even if it's assumed that the letter will be refused. Let's hope that's what's happening here.

Durbin should schedule a hearing invite Roberts + Alito invite retired federal judges invite judicial-ethics expert witnesses hold the hearing with whomever accepts invitations highlight Alito's appearance of partiality/bias for citizens loss aversion is strong, Ds can + should weaponize it

That's the only proper way to do it, IMHO. I totally agree with Roberts that it's improper for members of the Court to have some private meeting with senators (especially if just from one party). Any "meetings" about this should be public hearings in the full light of day, not backroom bullshit.
