I’ve been in shock since Monday AM. The fact the Supreme Court didn’t simply affirm the lower court’s ruling & dismiss Trump’s absurd claims of absolute immunity was appalling, given trial delays — but this is calamitous for democracy writ large. Like Dred Scott, “Trump vs U.S.” will be infamous.

After the Court’s decision yesterday, I think there’s an argument from necessity for Biden seizing Trump and trying him by military tribunal, given the sudden unavailability of Article III courts. Plus, itʼs just the sort of thing they’ve authorized an active and energetic chief executive to do.

People need to understand that dismantling the Voting Rights Act was Roberts’ lifelong project. He lied about it in his hearings with a bunch of balls and strikes stare decisis co-equal branches mumbo jumbo. Then eviscerated the VRA at the first opportunity.

Yes, but the key is that their belief is that the “unitary executive” is for Republicans only — Democrats can and should be thwarted at every step. This decision perfectly threads that needle, by leaving in the hands of this Court the ability to decide whether and to whom immunity applies.

Donald Trump abused his powers in a lot of "there's no recourse except impeaching him" ways and Biden mostly refused to do any of that and the reward he's received is that the Centrist Norms-Guarders who actually pretend to care about that stuff have now all called on him to step down.
