Article III is worth reading just to clarify how limited it is. Outside of a limited set of cases, Congress can create rules and exceptions around what the judiciary can rule on. Congress explicitly gets to set the structure of the courts. Judicial review of laws isn’t really in there.

i was just going to make a post about this. if trump decides you are an enemy of the state or a “threat to national security” and has you deported, citizenship or not, there’s nothing you can do to get home. he has full legal power to render you stateless.

Kagan's response on this is perfect. I'm not sure Roberts would even disagree that this is his preferred modus operandi.

A few years ago, Jon Lovett floated a theory that media treats Democrats like protagonists - to be challenged, accounted, and forced to be behave in growth-oriented ways - while the GOP are treated like antagonists - immutable, expected to disrupt, thematic obstacles. Thinking about that a lot.

Just remarkable how "old person won't retire" has driven history for the last 15 years. Kennedy not resigning after brain cancer diagnosis -> Scott Brown Feinstein staying on past prime and bungling hearings -> Kavanaugh/Barrett RBG Biden

Yes, if you don’t like the choice between Trump and Biden, think of it as picking between Stephen Miller and Pete Buttigieg, Steve Bannon and Deb Haaland, Michael Flynn and Lina M. Khan, Alex Jones and Jessica Rosenworcel, or Brett Kavanaugh and Ketanji Brown Jackson. Both sides are not “the same”

FDR saw “an impulse among a good many ‘strong’ men, men used to having their way, mostly industrialists who directed affairs without being questioned, a feeling that democracy had run its course and that the totalitarians had grasped the necessities of the time.”

David Weiss immunized the gun shop owner who altered the Hunter Biden gun purchase document so he could charge Joe Biden's son for owning a gun for 11 days in 2018. And of the 50 or so journos covering the case, I've seen only CNN even report that the form did get altered.

50 billionaire families have already poured $600M+ into this year's elections — mostly in support of Trump. That's only 0.6% of their total wealth. It essentially costs them nothing to drown our democracy in dark money.

I don't think people appreciate how bad things are in journalism and how terrible a blow it is to democracy. I have never seen the employment this iffy, wages this low, reporting this little in demand (by editors). You wonder how a column like Kathleen Parker's gets printed--that's who's left.

Led by Justice Alito, SCOTUS again takes over fact-finding.They simply will not defer to findings of a trial court that favor Black claimants in civil rts cases, women’s groups in abortion cases, or parties opposing state entanglement w/religion. They’ll either remake the law or redo the facts.
