right now, the extent of what democrats can do is hounding and shame, which they should do! biden should condemn the insurrectionist members of the court, durbin and whitehouse should hold hearings and demand that alito and thomas both answer questions before congress. make it a spectacle, basically
hold leo in contempt and threaten him with prison. these people are making lives of others materially worse, at least use state power to annoy them as much as possible
This is one thing I'd wish they'd take a page out of the republican's play book. Like do the Hunter Biden bullshit but with actual substance behind it. You might be surprised and get rewarded with the power to fix it
Also Roberts, to explain why he is not keeping a tighter rein on the ethical challenges of his Court. He wanted the job of Chief Justice, make him answer for the actions of his Court and why the ethics rules he put in place have obviously failed to rein in abuses.
At this point I'm looking back at how the house GOP spent years and millions of dollars showboating an "investigation" into Benghazi that never found anything, that spread lies, and energized their base and demoralized people that don't think oversight authority should be used that way
Unfortunately, aside from notable names like Sanders, Warren, or AOC, most Democrats specifically do not want spectacle, because they associate a media circus routine as being a dirty conservative tactic.
Biden reelection and local House campaign tactics based on the Democrats being the only bulwark against an MAGA insurrectionist Court is a powerful national strategy.
I agree but maybe with the exception that I think amiable grandpa is an important part of Biden’s appeal. But he has a ton of people who work with and for him, get them out there! Let them deal with his troublesome priests while he gets to eat ice cream and offer you rides in his 67 corvette
Do you think they'll do that in the lead up to the election? I agree this needs to be done ASAP. But considering every 3rd article is about the Biden camp freaking out about polling idk that anyone in there will do something like this.
That's about the only way to hold SCOTUS accountable. So much of what they do is shrouded in mystique and secrecy. Ripping their robes off and making them answer for the insane shit they decide and write is the only way to curb the behavior. They need to be shamed and mocked in a public forum
I would like to see the based Biden that said "There are at least three genders, don't play games with me" go to town on Alito and Thomas. That'd be neat. I'd like that a lot.
The Jamie Raskin proposal of having the DOJ petition the other justices to force their recusal seems like a good idea too. Won't work directly but it will make the rest of the court go on record and will make Alito and Thomas into more of a nuisance for Roberts (who at a minimum deserves that)
The Supreme Court is very unpopular right now. Making your campaign about pushing back on them and Trump is a good way to be popular. Just talk about Alito and Thomas as individuals, and the rulings they've been pushing out.
But what can we expect from Senator Milquetoast (D-IL) or Senator Dithering (D-NY)? These suggestions might be too bothersome at this time when bipartisanship is more important than evah!
The Democrats in Congress clearly had such a good time with that Speaker of the House vote spectacle! I'm sure they would love another good spectacle if they could screw their heads on straight about it! Maybe with a fun hat or something
But how do you get Alito or Thomas to actually appear before a committee? There is no way to force them to testify, is there? They can just ignore subpoenas, can't they?
Dems still have this "high road" mentality when dealing with the GOP, and that keeps getting them bowled over. Because you can't play nice with and try to win moral victories with fascists. They have no sense of shame, they do not care about hypocrisy, they care about power.
at this point it's hard to see the point of legitimizing this court--there's no reward at all.
It needs to become common knowledge (among the not-terminally-online) that the court is full of political hacks. They really need media help though
truly, a lot of them think it's someone else's job -- that some combination of advocacy groups, PACS and back benchers can "get it out there" or "do messaging"
they're also incredibly risk averse and still want some guarantee their tactics will "work" as opposed to viewing their power as dynamic
The Dem Senate committee chairs have largely been a disappointment. I get that they probably wanted to project seriousness vs. the House circus but it comes across as timidity. And they're probably not going to get another chance to use their power for a while.
I hope they do this.
One particular advantage is that Alito would be so appalled, he would almost certainly run his mouth in ways that would make headlines.
The DOJ could start investigating, publicly, and make sure the people know what suspect things Alito and Thomas have done even if not illegal – kind of like they did with Hillary one month before the 2016 election.
Congress has the "power of the purse" and can eliminate funding for their law clerks until they adopt a transparent and enforceable code of ethics. They can also require justices to ride circuit.
Wild the degree to which they don’t understand this. So many Americans don’t even know this stuff is happening. Trump has been showing them how to be loud all the time, consuming all the oxygen so people are constantly talking and thinking about him for almost 10 years and they still haven’t learned
One of the opportunities here is that Samuel Alito is *extremely* prickly and unable to shut up. The more spectacle you make, the more he'll make himself into the spectacle.
Also there are straightforward lines of questioning that, if answered remotely honestly, would get them to say they run things with complete impunity and that it’s ok to insurrect if the government becomes tyrannical.
one way in among many: statements of purported fact in his letter are convincingly contradicted by NYT reporting (e.g. who called names, etc.) www.nytimes.com/2024/05/28/u...
i think it was a fairly explicit part of biden's vision that shaming trump and his adherents was necessary for restoring the soul of country—yet he and every democrat seem pretty reluctant to do any actual shaming
People will be like, “The only way to defeat Trump/authoritarianism/fascism is politics.” And like, that’s true, which is why Democrats need to do exactly what you’re describing! That’s politics
